1. Agreement
These Terms & Conditions ("Terms") govern your use of the wako application and website (the "Service"), operated by Jean-Baptiste Malatrasi ("wako", "we", "us"). By downloading, accessing, or using the Service — or by creating an account — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
wako is a media tracking app, a media center, and a remote control for Kodi. It helps you track what you watch, organise and sync your library across your devices, control playback on your own Kodi devices, and play media from the services and sources you choose to connect. wako is software and an interface — not a content provider or distributor. It ships with no add-ons or content sources installed, and does not host, store, provide, index, or recommend any media content or content source.
3. Licence and restrictions
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purposes. You may not copy or modify the app, any part of the app, or our trademarks; attempt to extract the source code of the app; or create derivative versions, except to the extent such restrictions are prohibited by applicable law. The app, and all trademarks, copyright, database rights and other intellectual property rights related to it, remain the property of Jean-Baptiste Malatrasi.
4. Your account
Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date. You are responsible for keeping your device secure and for using a supported, unmodified operating system.
5. Subscriptions and payments
wako is offered on a freemium basis. Some features require a paid subscription, processed through Apple, Google, RevenueCat, or Stripe depending on your platform. Subscriptions renew automatically unless cancelled before the end of the current period, and are managed through your app store account or your wako account, as applicable. We will always make clear what you are paying for before any charge. We may change pricing or the features included in a plan; changes do not affect the period you have already paid for. Statutory rights of withdrawal apply where required by law.
6. Third-party add-ons and services
The Service lets you choose to install third-party add-ons and to connect third-party services. These add-ons and services are provided by third parties, not by wako, and are governed by their own terms and policies. wako does not control them, does not endorse any of them, and is not responsible for them or for any content, information, or functionality made available through them. Your use of any third-party add-on or service is between you and that third party.
7. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service — including any third-party add-ons or services you choose to connect — complies with all applicable laws and with the terms of the services and rights holders involved. You may not use the Service to infringe the intellectual property or other rights of any third party, or for any unlawful purpose. We may suspend or terminate accounts that we reasonably believe are used in breach of these Terms.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or available at all times. Some features rely on information provided by third parties and require an active internet connection; we are not responsible for the Service not working at full functionality where you lack connectivity, and any data charges from your provider are your responsibility.
9. Limitation of liability
To the maximum extent permitted by law, wako shall not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of third-party add-ons or services or from content accessed through them. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
10. Updates and termination
We may update the app from time to time; system requirements may change, and you may need to install updates to keep using it. We may also modify, suspend, or discontinue the Service, in whole or in part, at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, the rights granted to you under these Terms end and you must stop using the app and, if needed, delete it from your device.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and are effective once posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by French law, without prejudice to any mandatory consumer-protection rules of the country in which you reside. Any dispute will be subject to the jurisdiction of the competent French courts, subject to applicable consumer law.
